Travel Rule for crypto-asset service providers

Regulation (EU) 2023/1113 for CASPs and what a Travel Rule procedure must decide.

Since 30 December 2024 every crypto-asset service provider in the EU must send, receive and check information about the originator and the beneficiary of each transfer of crypto-assets — the "Travel Rule" of Regulation (EU) 2023/1113. The Financial Supervision Authority examines the Travel Rule procedure as part of a MiCA application, and applies it in supervision afterwards. This guide explains what the rule requires and what our Travel Rule set-up delivers.

What Regulation (EU) 2023/1113 requires

  • Originator's CASP (Article 14): every transfer carries the originator's name, distributed ledger address or account number, and address, official document number or customer number (or date and place of birth), and the beneficiary's name and address or account. There is no de minimis threshold for crypto-asset transfers.
  • Beneficiary's CASP (Articles 16–17): effective procedures to detect missing or incomplete information, and risk-based procedures to decide whether to execute, reject, return or suspend a transfer, and to follow up with the counterparty.
  • Self-hosted addresses (Article 14(5) and 16(2)): for transfers above EUR 1,000 to or from a self-hosted address, the CASP assesses whether the address is owned or controlled by its own customer.
  • Counterparty due diligence: before sending information to another CASP, especially outside the EU, the CASP assesses whether that counterparty can protect the data and is properly supervised (EBA Travel Rule Guidelines).
  • Records and reporting: records of the information, and reporting of repeated failures by a counterparty to the competent authority.

What the procedure must decide

  • which protocol or provider is used to exchange the information, and how interoperability with other protocols is handled;
  • what happens when information is missing, and who decides;
  • how self-hosted wallet ownership is verified (message signing, micro-transaction or other methods);
  • how Travel Rule data feeds into transaction monitoring and suspicious transaction reporting under the AML rules.

Frequently asked questions

Is there a minimum amount for the Travel Rule on crypto transfers?

No. Under Regulation (EU) 2023/1113 the originator and beneficiary information must accompany every transfer of crypto-assets, whatever the amount. For transfers above EUR 1,000 to or from a self-hosted address, the CASP must also assess whether the address belongs to its customer.

What must a CASP do when Travel Rule information is missing?

Have effective procedures to detect missing or incomplete information and risk-based procedures to decide whether to execute, reject, return or suspend the transfer, follow up with the counterparty, and report repeated failures to the authority.
